Acceptance of the Terms of Use

The services that Mobiland provides to you are subject to the following terms of use. Mobiland reserves the right to update these Terms of Use at any time without notice. The latest version of the terms of use can be viewed by clicking on the "Terms of Use" hyperlink at the bottom of our website. By using this website, including using its services, downloading its software, documents or files or browsing the site, you accept the terms of use set out below in this document.

Description of the services

Via the Internet, Mobiland gives you access to a variety of resources, including software, download areas, communication forums, product information and others (“services”). These services are subject to the terms of use.

Restriction to personal, non-commercial use

Unless otherwise stipulated, the services are offered exclusively for personal, non-commercial use. You are not permitted to change, copy, distribute, transmit, reproduce, publish, license, sell, or produce derived products of the information, software, products or services that you have obtained via your access to Mobiland services.

Information regarding the software available on this website

All software, including programs, tools, files and documents, made available for download by the services (“software”) is the copyrighted work of Mobiland and/or its suppliers. The use of the software is subject to the provisions of the end user license agreement, which is enclosed with or contained in the software ("license agreement"). End users are entitled to install software that includes a license agreement if they have previously agreed to the terms of that license agreement.

The software is made available to end users solely for downloading and further use within the meaning of the license agreement. Reproduction or redistribution of the software outside the terms of the license agreement is expressly prohibited by law and can have serious civil and criminal consequences. Violations will be prosecuted to the greatest extent possible.

In the absence of any restrictions regarding the aforementioned, copying or reproducing the software on another server or elsewhere with the aim of further reproduction or redistribution is expressly prohibited, unless such reproduction or redistribution is expressly permitted by the license agreement that comes with the software.

If there is a warranty for the software at all, this warranty exists only in accordance with the provisions of the license agreement. With the exception of the warranty specified in the license agreement, Mobiland hereby rejects any warranty and conditions relating to the software.

Information regarding the software, documents and services available on this website

Mobiland and/or its suppliers shall not be liable for special or indirect damage, consequential damage or other damage (including but not limited to the loss of profits, secrets or other information, the interruption of business activities, personal injury, the loss of privacy, the inability to perform a task in good time, or any other damage) that may have arisen as a result of or in connection with the use of software, documents, the provision or lack of provision of services or through information accessible via those services.

User account, password and security

If one of the services requires you to open a user account, you must provide current, complete and correct information about the data requested in the registration form. You can choose a password and a username. You are solely responsible for maintaining the confidentiality of your password and your account. In addition, you are solely responsible for all activities using this account. You agree to inform Mobiland immediately of any unauthorized access to accounts or any services. Mobiland is not liable for any damage caused to you by third parties using your password or your account with or without your knowledge. You may potentially be held liable for losses that Mobiland or third parties incur as a result of a third party using your account or password. You are not allowed to use a third party's account without their permission.

Code of conduct

You are authorized to use the services provided that you do not use the services for any purposes that are unlawful or that violate these terms of use. The services may not be used in a manner that could damage, deactivate, overload or impair Mobiland servers or the networks connected to a Mobiland server, or that could impair the use of the services by third parties. You are not permitted to gain unauthorized access to services, accounts, computer systems or networks connected to them by cracking codes, illegally obtaining passwords or employing other methods. You are also not allowed to attempt to obtain any materials or information not provided on the Mobiland website itself.

Use of services

The services may include email services, bulletin board services, chat areas, newsgroups, forums, communities, files and/or other messaging or communication facilities for communicating with other users (“communication services”). You are only permitted to use the communication services to provide, send and receive messages and related material relating to the communication service in question. With regard to the use of the communication services, you are prohibited from using the communication services for any purpose other than that for which they are intended, e.g. sending junk emails or spam, sending unsolicited messages or any other illicit usage.

Mobiland is not obliged to monitor the communication services. Mobiland nevertheless reserves the right to check materials stored in the communication services and to delete them at its own discretion. Mobiland furthermore reserves the right to block your access to all communication services at any time without prior notice and without giving reasons.

Mobiland further reserves the right, at any time, to publish any information that Mobiland deems necessary in order to comply with applicable law, legal processes or government requests, or to fully or partially edit, refuse to alter or remove any information and/or other materials at its sole discretion.

Caution should be observed when revealing your own personal information and your children's personal information as part of communication services. Mobiland does not monitor or approve the content, messages or information that can be accessed via the communication services. For this reason, Mobiland disclaims any liability in relation to the communication services and any actions resulting from your participation in those communication services. Managers and hosts are not authorized to speak on behalf of Mobiland and their views do not necessarily reflect those of Mobiland.

Materials uploaded to communications services may be subject to restrictions on use, reproduction, and distribution. You are responsible for complying with these restrictions if you download such materials.

Data sent to Mobiland or sent to a Mobiland website or service

Mobiland makes no claims to material (including feedback and suggestions) that you make available to Mobiland, other users or the public as uploads, inputs or broadcasts. However, Mobiland is entitled to remove such material at any time if there is reasonable suspicion that its use violates legal regulations or these terms of use plus the additional provisions or codes of conduct. You may publish, upload or transmit only content to which you hold the necessary rights (in particular copyright and ancillary copyrights).

By providing content on a communications service, you grant permission to (a) all members of the communications service (for anyone who has content accessible by a member), and/or (b) the general public (where available to the public) to use your content within the framework of the services as permitted by these terms of use (including, but not limited to, making copies and derivative works). No remuneration shell be payable for the use of your content. This paragraph applies solely to content that is legal and the publication or use of which does not violate applicable law.

In addition to the warranties and guarantees set out above, by fully or partially submitting a template that contains images, pictures, photographs or other graphic elements (“images”), you guarantee and warrant that (a) you are the owner of the copyright and ancillary rights to those images, or that the holder of the related property rights has granted you the right to use those images or the content and/or images contained therein, in accordance with the type of use and the intended use and as otherwise permitted in these terms of use, (b) that you own the rights necessary to grant the licenses and sublicenses described in these terms of use; and (c) that, where applicable, any person depicted in such an image consents to the image being used in the manner described in these terms of use, including but not limited to, the distribution, public exhibition and duplication of these images.

When you store images, you grant (a) all members of your private community (for any images that can be consulted by members of that private community) and/or (b) the general public (for any images that can be consulted within the services outside of the private community) permission to use your images in connection with the use of other services, where such permission is granted under these terms of use (including but not limited to printouts or giftware containing those images), including but not limited to a non-exclusive, worldwide, free license to copy, distribute, transfer, publicly display, publicly cite, duplicate, process, translate, reformat or attach your name to the image and the right to sublicense this right to the service provider. The license relating to images granted in the preceding section shall end at the point in time where you remove these images from the services completely, unless this termination has no effect on licenses granted prior to such images being completely removed from the services. No license fees shall be payable for the use of any images you have provided.

Links to third-party sites

The links on the Mobiland websites allow you to leave the Mobiland website and navigate to other websites. These other websites are not monitored by Mobiland. Mobiland is not responsible or liable for the content, links, changes or updates of external websites. Mobiland provides you with links to other websites in the interests of simplicity and does not claim any ownership of those websites by virtue of those connections ("hyperlinks").

Principle for the unsolicited transmission of ideas

Mobiland cannot guarantee that any ideas or material for new advertising campaigns, products, technologies, marketing strategies, product names, creative works or any other works that you send us will be kept secret and treated with confidentiality.

Applicable law

This agreement is subject to Swiss law. The exclusive place of jurisdiction for disputes is the registered office of Mobiland. However, Mobiland is entitled to file a legal dispute with the court responsible for your place of residence or registered office.

Mobiland reserves all rights not expressly granted in this document.
