Acceptance of the terms of use

The services that Mobiland offers you are subject to the following terms of use. Mobiland reserves the right to update these Terms of Use at any time without notice. The latest version of the terms of use can be viewed by clicking on the "Terms of Use" hyperlink at the end of our website. By using this website, including using services, downloading software, documents, files or browsing the site, you accept the terms of use set out below in this document.

Description of the services

Mobiland gives you access to a variety of resources, including software, download areas, communication forums, product information and other (“services”) over the Internet. These services are subject to the terms of use.

Restriction to personal, non-commercial use

Unless otherwise regulated, the services are offered exclusively for personal non-commercial use. You are not permitted to change, copy, distribute, transmit, reproduce, publish, license, sell, or produce derived products, information, software, products or services that you have obtained under access to Mobiland services.

Information regarding the software available on this website

All software, including programs, tools, files and documents, made available for download by the services (“software”) is the copyrighted work of Mobiland and/or its suppliers. The use of the software is subject to the provisions of the end user license agreement which is enclosed with or contained in the software ("license agreement"). End users are entitled to install software that includes a license agreement if they have previously agreed to the terms of the license agreement.

The software is only made available to end users for downloading and further use within the meaning of the license agreement. Reproduction or redistribution of the software outside the terms of the license agreement is expressly prohibited by law and can have serious civil and criminal consequences. Violations will be prosecuted to the greatest extent possible.

Without restrictions regarding the aforementioned, copying or reproducing the software on another server or elsewhere with the aim of further reproduction or redistribution is expressly prohibited, unless such reproduction or redistribution is expressly permitted by the license agreement, which comes with the software.

Warranty for the software exists (if at all) only in accordance with the provisions of the license agreement. With the exception of the warranty specified in the license agreement, Mobiland hereby rejects any warranty and conditions relating to the software.

Information regarding the software, documents and services available on this website

Mobiland and/or its suppliers are not liable for special or indirect damage, consequential damage or other damage (including but not limited to the loss of profit or secrets or other information, the interruption of business activities, personal injury, the loss of privacy or the inability to perform a task in good time to be able to solve or other damage) which have arisen as a result of or in connection with the use of software, documents, the provision or absence of the provision of services or through information accessible via services.

User account, password and security

If one of the services requires the opening of a user account, you must provide current, complete and correct information about the data requested in the registration form. You can choose a password and a username. You are solely responsible for maintaining the confidentiality of your password and your account. In addition, you are solely responsible for all activities using this account. You agree to inform Mobiland immediately of any unauthorized access to accounts or any services. Mobiland is not liable for any damage caused to you by third parties using your password or your account with or without your knowledge. There is a possibility that you can be held liable for losses that Mobiland or third parties incur as a result of a third party using your account or password. You are not allowed to use a third party account without their permission.

Code of conduct

Your use of the services is permitted provided that you do not use the services for purposes that are unlawful or violate these terms of use. The services may not be used in a way that could damage, deactivate, overload or impair Mobiland servers or the networks connected to a Mobiland server, or that could impair the use of the services by third parties. You are not permitted to gain unauthorized access to services, accounts, computer systems or networks connected to them by cracking codes, illegally obtaining passwords or other methods. You are also not allowed to try to obtain materials or information if this is not provided for in the Mobiland website itself.

Use of services

The services may include email services, bulletin board services, chat areas, newsgroups, forums, communities, files and/or other messaging or communication facilities for communicating with other users (“communication services”). You are only permitted to use the communication services to provide, send and receive messages and related material relating to the respective communication service. With regard to the use of the communication services, you are obliged not to use the communication services for what they are not intended for, e.g. the sending of junk emails or spam, the sending of unsolicited messages or other.

Mobiland is not obliged to monitor the communication services. Mobiland nevertheless reserves the right to check materials stored in the communication services and to delete them at its own discretion. Mobiland furthermore reserves the right to block your access to all communication services at any time without prior notice without giving a reason.

Mobiland further reserves the right, at any time, to publish any information that Mobiland deems necessary to comply with applicable law, legal processes or government requests, or to fully or partially disclose information and/or other materials at its sole discretion edit, refuse to set them or remove them.

Be careful about revealing your own personal information and your children's personal information as part of communication services. Mobiland does not control and approve the content, messages or information that can be called up in communication services. For this reason, Mobiland disclaims liability in relation to the communication services and any actions resulting from your participation in communication services. Managers and hosts are not authorized Mobiland speakers and their views do not necessarily reflect those of Mobiland.

Materials uploaded to communications services may be subject to restrictions on use, reproduction, and distribution. You are responsible for complying with these restrictions if you download such materials.

Data sent to Mobiland or sent to a Mobiland website or service

Mobiland makes no claims to material (including feedback and suggestions) that you make available to Mobiland, other users or the public as upload, input or broadcast. However, Mobiland is entitled to remove this material at any time if there is reasonable suspicion that its use violates legal regulations or these terms of use and additional additional provisions or codes of conduct. You may only publish, upload or transmit content to which you have the necessary rights (in particular copyright and ancillary copyrights).

By providing content on a communications service, you give (a) permission to all members of the communications service (to anyone who has content accessible by a member), and/or (b) to the general public (where available to the public) to use your content within the framework use the Services as permitted by these Terms of Use (including, but not limited to, making copies and derivative works). No remuneration is paid for the use of your content. This paragraph only applies to content that is legal and the publication or use of which does not violate applicable law.

In addition to the warranties and guarantees set out above, by fully or partially submitting a template that contains images, images, photographs or other graphic elements (“images”), you guarantee and warrant that (a) you are the owner of the copyright and ancillary rights this image, or that the holder of the related property rights has granted you the right to use this image or the content and/or images contained in such an image, in accordance with the type of use and the intended use and otherwise permitted in these terms of use, (b) that you own the rights necessary to grant the licenses and sublicenses described in these Terms of Use; and (c) that, where applicable, any person depicted in such an image consents to these Terms of Use described use of the image ng, including but not limited to e.g. distribution, public exhibition and duplication of these images.

By storing images, you clear (a) all members of your private community (for each image that is available to members of the private community), and/or (b) the general public (for each image that is within the services outside of the permission to use your images in connection with the use of other services, as permitted in these terms of use (including but not limited to printouts or gift items containing these images), including but not limited to one exclusive, worldwide, royalty-free license to copy, distribute, transmit, publicly display, perform publicly, reproduce, edit, translate, reformat without affixing your name to the image and granting you the right to sublicense this right to the service provider . The license granted in the preceding sentences relating to images ends at the point in time when you completely remove these images from the services, unless this termination does not affect licenses in connection with such images before the time of complete removal the image has been granted from the services. No license fees are paid for the use of the images you have set.

Links to third party sites

The links on the Mobiland websites allow you to leave the Mobiland website and jump to other websites. These other websites are not controlled by Mobiland. Mobiland is not responsible or liable for the content, links, changes or updates of external websites. Mobiland provides you with the links to other websites only for the sake of simplicity and does not adopt their content through this link ("hyperlinks").

Principle for unsolicited transmission of ideas

Mobiland cannot guarantee that ideas or material for new advertising campaigns, products, technologies, marketing strategies, product names, creative works or any other work that you send us will be treated as confidential and confidential.

Applicable law

This agreement is subject to Swiss law. The exclusive place of jurisdiction for disputes is at the registered office of Mobiland. Mobiland is, however, entitled to file a legal dispute with the court responsible for your place of residence or registered office.

Mobiland reserves all rights not expressly granted in this document.
